Palm Sued Over Defective Treos
News by Michael Oryl on Wednesday September 21, 2005.
A class action lawsuit has been filed in the state of California against Palm and as-yet unspecified others by three Treo owners. The suit, filed by Mario Palza of California, Charles Boulais of New Jersey, and Nissa Gay of California, claims that Palm knowingly has misrepresented the Treo 600 and 650 handsets as being "quick, dependable and reliable" devices. The plaintiffs in the case claim that is not the case, citing a cycle of issues and repairs connected to the devices. The suit also alleges that Palm has concealed the "fact" that the Treo devices "fail at an unacceptably high rate" and are "inherently defective".
Each of the plaintiffs contributes a list of issues that he or she has had with their personal Treo device. While some of the issues seem to be widely known (buzzing audio problem in the 600), others, such as "Camera does not function", "MP3 player is useless", and "inability to efficiently eliminate duplicate information" do not seem so concrete.
The goal of the suit is to get defective Treo owners functioning replacement devices or full refunds, as well as recoup the cost of legal fees, and exact punitive damages. You can find a copy of the legal complaint here.
