Samsung Galaxy Tab 10.1 ban in Germany upheld by appeals court

An appeals court in Dusseldorf, Germany has upheld the ban on sales of the Samsung Galaxy Tab 10.1 tablet that went into effect in August 2011 and was upheld in September 2011.

The Dusseldorf court also determined that the smaller Galaxy Tab 8.9 falls under the injunction as well. Interestingly enough, the court said that it was not Apple's design rights that the Samsung tablets were in violation of, but rather a German unfair competition law.

Of course, last fall Samsung released the Galaxy Tab 10.1N to circumvent the injunction against the original Galaxy Tab 10.1, and that is still on the market and is not affected by today's court decision. This essentially makes the ban moot in the eyes of the consumer market. Apple has also filed a petition for an injunction against the modified Galaxy Tab 10.1N, but the courts have not granted that at this time. [via FOSS Patents]
