U.S. District Judge Lucy Koh said in court yesterday that Samsung's line of Galaxy Tab tablets infringe upon Apple iPad patents, but that Apple will have to prove the validity of those patents to win an injunction.

According to Reuters, the judge seems to think Apple might have trouble proving that the patents in question a valid under U.S. law. Koh said in court that she would deny Apple's request for a sales injunction on Samsung's tablets based on one of its so-called "utility" patents. The judge characterized her thoughts on that patent as being still "tentative."

The judge did not comment on the three design based patents that are also part of the company's long-running patent battle with Samsung. Apple recent won an injunction against Samsung in Australia.
